1. Agreement to Terms

By booking our services or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services

Shineoeskeleton provides event decor and party styling services including but not limited to:

• Balloon installations and arrangements
• Table styling and decor
• Photo zones and backdrops
• Theme design and concept development
• Setup and pack down services

We do not provide catering, venue rental, or large-scale corporate event services.

3. Booking and Payment

Booking Confirmation: A booking is confirmed upon receipt of the required deposit and signed agreement.

Deposit: A non-refundable deposit of 50% is required to secure your date.

Final Payment: The remaining balance is due 7 days prior to your event.

Payment Methods: We accept bank transfer and major credit cards.

4. Cancellation Policy

• More than 30 days before event: Full refund minus deposit
• 15-30 days before event: 50% of total booking refunded
• Less than 15 days before event: No refund
• Rescheduling: One reschedule is permitted with at least 14 days notice, subject to availability

5. Setup and Access

You agree to provide:

• Access to the venue at the agreed time (typically 2-3 hours before the event)
• Accurate information about the venue including dimensions and restrictions
• Permission for our team to be present during setup and pack down

6. Decor Items

All decor items, props, and styling elements provided by Shineoeskeleton remain our property unless otherwise agreed in writing. We will collect these items after your event. Any damage to or loss of our items will be charged at replacement cost.

7. Photography and Portfolio

We may photograph our work at your event for use in our portfolio, website, and social media. If you wish to opt out, please notify us in writing before your event.

8. Liability

Shineoeskeleton takes reasonable care in providing our services. However:

• We are not liable for damage caused by venue conditions, weather, or third parties
• We are not responsible for injuries caused by misuse of decor items
• Our liability is limited to the total amount paid for services

9. Force Majeure

We are not liable for failure to perform due to circumstances beyond our control, including natural disasters, pandemics, government restrictions, or other unforeseen events. In such cases, we will work with you to reschedule or provide a suitable alternative.

10. Intellectual Property

All designs, concepts, and creative ideas presented by Shineoeskeleton remain our intellectual property until full payment is received.

11. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date.

12. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.

13. Consumer Guarantees (New Zealand Consumer Law)

Under the Consumer Guarantees Act 1993, you have certain guarantees when you purchase our services in New Zealand:

• Guarantee of acceptable quality: Our services will be of acceptable quality, fit for purpose, and match any description we provide
• Guarantee of fitness for purpose: Our services will be suitable for the purpose you made known to us
• Guarantee as to time for completion: Services will be completed within a reasonable time
• Right to remedies: If we fail to meet these guarantees, you may be entitled to a remedy, which may include repair, replacement, refund, or compensation

These guarantees cannot be excluded, restricted, or modified for services provided to consumers in New Zealand. However, if you are purchasing our services for business purposes, you may contract out of some guarantees with our written agreement.

14. Pricing and Currency

All prices are quoted in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) where applicable. Prices are valid for the period stated in your quote and may be subject to change if your requirements change or if there is a significant delay between quote and booking confirmation.

We reserve the right to adjust prices for events booked more than 6 months in advance to account for inflation and cost increases. Any price adjustments will be communicated to you in writing before they take effect.

15. Venue Requirements and Restrictions

You are responsible for ensuring that:

• The venue permits our styling services and any installations we plan to create
• We have adequate access to the venue at agreed times for setup and pack down
• The venue has appropriate facilities (power outlets, suitable surfaces, etc.) for our installations
• Any venue-specific restrictions or requirements are communicated to us in advance

If venue restrictions prevent us from delivering services as planned, we will work with you to find alternative solutions. Additional charges may apply if alternative arrangements require extra time or resources.

16. Weather and Outdoor Events

For outdoor events, we will assess weather conditions and make recommendations regarding the suitability of our decor items. Some items may not be suitable for certain weather conditions (e.g., strong winds, heavy rain).

If weather conditions pose a safety risk or would significantly damage our decor items, we may:

• Modify the installation to be weather-appropriate
• Recommend moving the event indoors or to a covered area
• Cancel the service if conditions are unsafe (subject to our cancellation policy)

We are not liable for weather-related damage to decor items or inability to complete installations due to adverse weather conditions.

17. Complaints and Dispute Resolution

If you have a complaint about our services, please contact us as soon as possible. We are committed to resolving complaints fairly and promptly. Our complaints process:

1. Initial Contact: Contact us within 48 hours of your event to discuss your concerns
2. Investigation: We will investigate your complaint and respond within 5 business days
3. Resolution: We will work with you to find a mutually acceptable resolution
4. External Resolution: If we cannot resolve the matter, you may contact the New Zealand Disputes Tribunal or seek advice from Consumer Protection New Zealand

18. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• Our total liability for any claim arising from our services is limited to the total amount you paid for the specific service in question
• We are not liable for indirect, consequential, or special damages, including loss of profits, loss of data, or loss of enjoyment
• We are not liable for delays or failures to perform due to circumstances beyond our reasonable control

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

19. Intellectual Property and Design Rights

All designs, concepts, mood boards, and creative work created by Shineoeskeleton remain our intellectual property until full payment is received. After full payment:

• You receive a license to use the designs for your specific event
• We retain the right to use photographs and designs in our portfolio and marketing materials
• You may not reproduce, modify, or use our designs for commercial purposes without our written permission

If you provide us with designs, images, or concepts, you warrant that you have the right to use and share them with us, and you grant us a license to use them for your event.

20. Google Ads Compliance

We comply with Google Ads policies applicable to New Zealand, including:

• Accurate representation of our services and pricing
• Transparent business practices and contact information
• Compliance with New Zealand advertising standards and consumer protection laws
• Respect for intellectual property rights
• Prohibition of misleading or deceptive conduct

If you believe any of our advertisements violate Google Ads policies or New Zealand advertising standards, please contact us or report directly to Google.
